Allied Capital receives federal subpoena |

WASHINGTON (AFX) - Debt and equity financing company Allied Capital Corp. said Tuesday it received a subpoena from the U.S. Attorney's Office for the District of Columbia in late December seeking records of the company's use of private investigators.The company said it found that one of its agents obtained what 'what were represented to be' 2005 phone records of David Einhorn and his calls from Greenlight Capital. Einhorn is the president and founder of the hedge fund. In an open letter last month, he called for the removal of the company's managers and suggested the company knew about alleged fraud at its Business Loan Express LLC subsidiary for years.Allied Capital added that while it was gathering documents for the subpoena, it was alleged that its management authorized obtaining Einhorn's phone records, and was later told that the records were obtained.The company said the allegations are not true.Allied Capital said it is cooperating with the inquiry and will have no further comment concerning this matter until it has been completed.Copyright 2006 Associated Press.
