Martek drops European patent appeal |

COLUMBIA, Md. (AFX) - Martek Biosciences Corp., which makes nutritional oils to supplement baby food, said Thursday it is dropping a years-old patent appeal in Europe.The company withdrew its appeal at the European Patent Office in regard to its European DHA/ARA Oil Blends patent. A November 2004 decision by the court revoked the patent after it was challenged by two competitors.The patent, which is now considered revoked, was one of three patents covering the company's infant formula in European markets.'Management believes that this action will not have a material impact on the company's sales into the infant formula industry due to its other issued European patents that protect its individual DHA and ARA technologies and the terms of certain contracts the company maintains with its infant formula customers,' the company said in a statement.Shares of Martek rose 15 cents to $23.79 on the Nasdaq in afternoon trading.Copyright 2006 Associated Press.
