HONOLULU - Aloha Airlines announced that it will pursue further legal action against Mesa Air Group Inc. in federal court.Aloha sued Mesa in state court in October, alleging the Phoenix-based company improperly used data it obtained as a potential investor to try to drive Aloha out of business.'Upon further legal review of the federal antitrust laws, and given findings of federal Bankruptcy Judge Robert Faris in the Hawaiian Airlines matter, we believe our claims would be best pursued in the federal court system,' David A. Banmiller, Aloha's president and chief executive, said Monday. 'Aloha will continue to proceed vigorously against Mesa to stop the illegal and improper conduct.'Mesa, which had been considering investing in Aloha when the island carrier was undergoing bankruptcy reorganization, launched go! airlines in June as a competing carrier in Hawaii, entering the market dominated for decades by Hawaiian and Aloha airlines.Hawaiian, now a unit of Hawaiian Holdings Inc., sued Mesa in February for the alleged illegal use of confidential information and trade secrets obtained during Hawaiian's Chapter 11 bankruptcy proceedings,Speaking in connection with the Hawaiian case, Faris said in October that there was evidence that 'raises real doubts about the propriety of Mesa's conduct.'Mesa has denied Hawaiian's allegations.A Mesa spokesman said Aloha's lawsuit was a 'desperate act by a desperate carrier.'Aloha said it is seeking damages and injunctive relief to stop Mesa from competing unfairly and from threatening the jobs of 3,500 Aloha employees in Hawaii.Copyright 2006 Associated Press.
