Barr stops challenge to Zyprexa patent |

WOODCLIFF LAKE, N.J. (AP) - Barr Pharmaceuticals Inc. said Monday it is no longer challenging a patent protecting Eli Lilly & Co.'s orally disintegrating anti-psychotic medication Zyprexa Zydis.The company based its decision on a federal court affirmation of the patent in Lilly's lawsuit against Zenith Goldline Pharmaceuticals, Teva Pharmaceutical Industries Ltd. and Dr. Reddy's Labs Ltd.Barr had filed an application with the Food and Drug Administration for a version of Zyprexa Zydis in 2004. Barr's application had directly challenged Lilly's patent. The company said it changed the FDA application in April, resulting in Lilly dropping a lawsuit against it late last week.Barr expects to receive an FDA approval for a generic version of the drug when patent protection expires in 2011.Shares of Barr rose 8 cents to $52.65, and Lilly shares rose 48 cents to $57.50 in afternoon trading.Copyright 2007 Associated Press.
