LONDON (Thomson Financial) - Media regulator Ofcom has accused broadcasters of 'systemic failure' in their use of premium-rate phone competitions and called for a series of changes in broadcaster's licenses to better protect consumers in the future.

Publishing the findings of a four-month inquiry into TV phone-in competitions Ofcom said generating revenues was a 'major driver' in the growth of the lucrative competitions.

It said that some broadcasters appeared to be 'in denial' about their responsibilities to ensure programmes kept their promises to viewers.

Over the past month Ofcom has fined the BBC and Channel Five for faking winners of phone-in competitions.

This inquiry shows the extent to which there has been a systemic failure of compliance, Ofcom chief executive Ed Richards said in a statement.

Ofcom takes these issues extremely seriously and will continue to take action against broadcasters found to break the rules in this area. To restore trust with viewers, broadcasters need to deliver and demonstrate strong consumer protection as well as quality programming.'

The report's recommendations include requirements for consumer protection in relation to premium rate phone-ins for TV, and possibly for radio; requiring third-parties to audit premium-rate phone-ins; and issuing further guidance on the broadcasting code.

Ofcom said it would consult on its recommendations as part of its broader consultation on 'Participation Television', which is due to be published in the next few weeks.
