Endo receives subpoena on Lidoderm |

CHADDS FORD, Pa. (AFX) - Pain treatment developer Endo Pharmaceuticals Holdings Inc. said Wednesday it received a subpoena from the U.S. Department of Health and Human Services regarding promotional practices for Lidoderm.The subpoena, delivered to subsidiary Endo Pharmaceuticals Inc., requests documents from 1999 to the present dealing with sales and promotional practices for the post-shingles pain treatment. Specifically, it seeks documents dealing with the company's knowledge of off-label uses for the treatment.Off-label treatment refers to using a drug for a reason other than that for which it was approved. Physicians have leeway to prescribe drugs for off-label use but pharmaceutical companies are not permitted to market drugs for non-approved uses.'We have a strong ethics and compliance program,' said Peter A. Lankau, president and chief executive, in a statement. 'To that end, we routinely conduct extensive training for our employees to reinforce the importance of promotional practices that are within the FDA-approved indication.'Shares of Endo rose 37 cents to $29.20 on the Nasdaq in afternoon trading.Copyright 2006 Associated Press.
