(Updates with detail of daily fine, previous ruling)BRUSSELS (AFX) - The European Commission said it is proposing to take the French government to the European Court of Justice for the second time over high nitrate levels in waterways in Brittany.The commission said it is also proposing a lump sum fine of 28 mln eur and a daily penalty of 117,882 mln eur against France for not complying with a ruling by the court in 2001.The commission said that before launching the legal action, it will give the French government the opportunity to outline measures to tackle the problem.victoria.main@afxnews.comvm/cml/vm/jsaCOPYRIGHTCopyright AFX News Limited 2007.
