WOODCLIFF, N.J. (AFX) - Barr Pharmaceuticals Inc. said Tuesday Celgene Corp. filed a lawsuit alleging that Barr's generic version of Thalomid capsules infringes the drug's patent.Barr is challenging Celgene's patent for 50 milligram, 100-milligram and 200-milligram by asking the Food and Drug Administration for approval of various generic doses in September and December. Celgene previously said it would file a complaint alleging patent infringement if Barr asked for FDA approval.The drug is approved to treat leprosy and multiple myeloma. Summit, N.J.-based Celgene filed the lawsuit in the U.S. District Court of New Jersey.Shares of Barr rose 18 cents to close at $55.70 on the New York Stock Exchange in afternoon trading while shares of Celgene rose 4 cents to close at $54.22 on the Nasdaq Stock Market.Copyright 2006 Associated Press.
