Roche loses Amgen patent dispute court case in US |

ZURICH (Thomson Financial) - Roche Holdings AG has lost a patent infringement case in the US brought against it by Amgen Inc over its long-acting erythropoeitin (EPO) Mircera, said a Roche spokeswoman.'Roche is disappointed with the court's decision because we think it is a loss for patients with kidney disease,' said the spokeswoman, speaking to Thomson Financial News.The Swiss pharma group is evaluating its legal options including the possibility of an appeal.The spokeswoman declined to comment on the US launch of Mircera, 'given the current situation'.Amgen alleged that the drug infringes composition patents owned by the US pharma group, but Roche maintains that Mircera does not violate any patent.The pharma group had previously said it still plans to launch anaemia drug Mircera in the US as soon as it receives FDA approval.Mircera had been expected to receive approval for renal anaemia in the US at the end of the year, and was set to compete with Amgen's blockbusters Epogen and Aranesp, as well as Johnson & Johnson's Procirt.sarah.fenwick@thomson.comsf/jlcCOPYRIGHTCopyright Thomson Financial News Limited 2007.
