Schering suing Barr over generic Temodar |

NEW YORK (AP) - Barr Pharmaceuticals Inc. said Tuesday Schering-Plough Corp. filed a lawsuit against subsidiary Barr Laboratories Inc. over plans to make a generic version of the brain tumor treatment Temodar.The drug is approved to treat a type of brain tumor called anaplastic astrocytoma. The lawsuit was filed July 20 by Schering and patent holder Cancer Research Technology in the U.S. District Court of Delaware. It aims to keep Barr from selling the generic version.Barr applied with the Food and Drug Administration for approval of the generic version in March and the application was accepted for review in June. The company hopes to gain approval to sell 5, 20, 100, and 250-milligram capsules.During the second-quarter of 2007, Schering-Plough reported Temodar sales of $216 million, marking a 26 percent increase from the same period a year prior.Shares of Schering-Plough rose 3 cents to $31.33 in morning trading, while shares of Barr slipped $1.46, or 2.6 percent, to $54.06.Copyright 2007 Associated Press.
