Pfizer sees mixed ruling in Lipitor case |

NEW YORK (AP) - Drug developer Pfizer Inc. said Wednesday a Spanish court upheld its patent covering the active ingredient in the blockbuster cholesterol drug Lipitor, though it did find a second patent for the drug invalid.The company is facing a generic challenge by drug maker Ranbaxy. Pfizer sells Lipitor in Spain under the names Zarator and Cardyl.The decision by the court upholds the patent covering the calcium salt of atorvastatin but found the patent covering the stabilized formulation that includes atorvastatin is invalid. This is the fourth in a series of challenges to the patent by generic companies in Spain, Pfizer said. All previous decisions are currently on appeal.Pfizer said the calcium salt patent expires in July 2010 and the stabilized formulation patent was set to expire in 2013, though the company did not say what would happen now that the second patent is invalid.Lipitor sales fell 13 percent to $2.72 billion during the second quarter.Copyright 2007 Associated Press.
