LONDON (Thomson Financial) - Smokeless tobacco developer Star Scientific, Inc said it has initiated the appeals process in its patent infringement lawsuit against RJR Reynolds Tobacco Company Inc by filing a notice of appeal with the US District Court in Maryland.Star Scientific said it is appealing, and will seek expedited review, of the January 19, 2007 summary judgment rulings as well as the Court's ruling on inequitable conduct, which was issued earlier this week.The company said the appeal will be taken up by a three-judge panel in the US Court of Appeals for the Federal Circuit, and said it looks forward to having that court consider these issues.The six-year old disagreement began when Star sued Reynolds, claiming it infringed on its patent for a process that both companies say reduces certain cancer-causing toxins in tobacco.The ruling earlier this week said Star engaged in inequitable conduct before the US Patent Office in obtaining patents involving a method of treating tobacco to substantially prevent the formation of tobacco-specific nitrosamines.tf.TFN-Europe_newsdesk@thomson.comrwCOPYRIGHTCopyright AFX News Limited 2007.
