FRANKFURT (Thomson Financial) - SAP AG is seeking an out-of-court settlement in the ongoing legal dispute with Oracle Corp over the alleged theft of secret product information, the company said in a statement ahead of a meeting with a district court judge on Sept 4.'As with most cases, prompt resolution of this case is in the best interest of all concerned,' the company said, calling for 'mediation with an active or retired magistrate judge within the next few months'.At the same time, SAP said Oracle's statement of facts is 'dramatic but inaccurate'.In March, Oracle filed a lawsuit at a San Francisco federal court alleging SAP's US subsidiary TomorrowNow downloaded secret product information from its website.'It ignores that none of the support materials downloaded by TomorrowNow were provided to SAP America or SAP AG,' the SAP statement said.It is a matter of contract interpretation, not of 'corporate theft on a grand scale' as stated in Oracle's complaint, SAP said.TomorrowNow offers services for customers, who are using software of Oracle subsidiaries such as Siebel or PeopleSoft.Following the meeting on Sept 4, the court is expected to issue an order with decisions on matters such as trial dates and alternative dispute resolutions.christoph.steitz@thomson.comcs1/mas/slmCOPYRIGHTCopyright AFX News Limited 2007.
